Chapter First: Execution Department and Its General Jurisdiction

Article 827

Article 827 - An enforcement circuit is affiliated with the Court of First Instance, presided over by a single judge in the region under its jurisdiction. If there are multiple single judges, it is presided over by the one to whom this task is entrusted. The president of the enforcement circuit is assisted by an enforcement officer or more than one judicial assistant. The phrase "enforcement circuit" shall replace the phrase "proceedings circuit" in any text in which it appears.

Article 829

Article 829 - Except as otherwise provided, the President of the Enforcement Department is authorized to issue decisions and orders related to enforcement, and is exclusively competent to settle the fundamental issues related to enforcement procedures and to make decisions thereon with urgency. The President of the Enforcement Department may decide, in accordance with the principles applied in urgent cases, to suspend enforcement and order the plaintiff in a non-procedural dispute to appeal to the court of substance within a time limit set by him, under penalty of resuming enforcement if the appeal is not filed within the time limit. He may also, based on a claim filed with him by a debtor with a monetary debt against the creditor within the warning period and aiming to grant him a payment deadline, decide, in accordance with the conditions set out in Articles 538 and 539, to grant the debtor a deadline not exceeding six months, without preventing the taking of precautionary measures. In all cases, the President of the Enforcement Department may suspend enforcement temporarily, with or without guarantee, and even without summoning the opponent, until a decision is issued.

Article 830 - Jurisdiction for execution of judgments, awards and court orders shall rest with the Division whose seat is at the center of the Court of First Instance that examined the case for which the judgment was rendered...

Article 831 - If the funds to be executed against, or some of them, are located outside the area of the circle to which the execution is required, it must delegate the circle in which the funds are located to carry out the execution proceedings and deposit the collected funds.

Article 832

Article 832 - The enforcement officer, under the supervision of the Head of the Department, shall carry out all necessary actions for enforcement, particularly the following: 1- Receiving petitions and documents, recording them in the registers with sequential numbers, and providing the submitter with a receipt thereof without a stamp, organizing a file for each case, and drafting a minutes report detailing the transactions and decisions issued by the Head, which shall be signed by him. 2- Collecting the amounts paid in settlement of debts and depositing them in the treasury, and distributing them, as well as collecting the amounts realized from the sale of seized assets and depositing them in an approved bank pursuant to a decision by the Head, and distributing them. The enforcement officer may, when necessary, seek the assistance of the public force directly or through the Department's presidency or the Public Prosecution. He is also entitled to affix seals without prior authorization from his superior.

Article 833

Article 833 - Whoever unlawfully obstructs an execution officer after announcement of his official capacity shall be subject to the punishment provided in Article 379 of the Penal Code.

Article 834

Article 834 - It is prohibited for the employees of the execution departments, under the penalty of applying the punishment stipulated in Article 364 of the Penal Code, to purchase for themselves, or through intermediaries, or on behalf of others, properties put up for public auction or seized by the department to which they belong.
