Part Second: Preparation of Conditions of Sale

Article 965

The execution officer, upon the request of the garnisher, shall prepare a sale conditions booklet within eight days from the date of registration of the property description minutes he organized, which shall include: 1. A summary of the previous proceedings. 2. A statement of the seized properties, their contents, the rights they have, and the burdens they bear, in accordance with the land registry records, or the Mukhtar's booklet, or the real estate register not subject to the land registry system, or the determination and release minutes held by the real estate judge, and the supporting documents, and in accordance with the property description minutes. 3. The sale conditions and the auction price, as determined by the head of the execution department based on six-tenths of the estimated value of the properties.

Article 966

The execution officer shall send within three days from the date of establishment of the book of conditions a notice to the debtor and to the owner of a real right or creditor registered on the property and to every creditor who has become party to the seizure.

Article 967

After the lapse of ten days from the date of the last notification of the ongoing news in accordance with the provisions of the previous article, the President of the Execution Department shall consider the submitted observations without the need to summon the parties, and shall, if necessary, amend the specification book on the basis thereof, and his decision regarding these observations shall be final without the need for any notification. The President of the Execution Department shall, after the expiration of the aforementioned deadline, consider the objection stipulated in the previous article in accordance with the established principles for considering execution problems.

Article 968

The book of conditions becomes final and not subject to modification if the period specified in Article 966 expires without the submission of observations or objections thereto or after the issuance of the decision referred to in the preceding article.
