Article 3
1. It is not permissible for the judge to issue his judgments in the form of regulations.
Article 4
The judge must not, under penalty of being considered to refuse justice: 1- Refrain from deciding on the grounds of ambiguity or absence of a legal text. 2- Delay without cause in issuing judgment. When the text is ambiguous, the judge interprets it in the meaning that produces an effect intended by the law.
Article 5
The new laws of procedure shall apply immediately to all cases and proceedings that have not been adjudicated or completed prior to the date of their entry into force. The following are exempted from this provision: 1- The laws amending jurisdiction, provided that the date of their entry into force is subsequent to the conclusion of the trial in the case or the issuance of a judgment settling an issue related to the subject matter. 2- The laws amending deadlines, provided that the deadline had commenced prior to their entry into force. 3- The laws governing the methods of appeal with regard to judgments or arbitration decisions issued prior to the date of their entry into force, provided that these laws abolish or establish one of these methods. 4- The laws governing compulsory execution with regard to judgments and decisions issued prior to the date of their entry into force, provided that these laws permit or prohibit execution.
Article 6
The general rules of the Code of Civil Procedure shall be applied in case of a deficiency in the other procedural laws and regulations.
