Title Ninth: Final Provisions
Article 1025
A register for civil partnerships shall be established at the office of the chamber of the court of first instance dealing with civil cases. The manner of keeping and the effects of the registration thereof shall be determined by a decree adopted by the Council of Ministers upon the proposal of the Minister of Justice.
Article 1026
All provisions of this Law that specifically mention cash amounts may be amended with respect to these amounts by a decree issued in the Council of Ministers upon the proposal of the Minister of Justice. It is also permissible, during a period of eighteen months from the date of publication of this Law, to introduce any amendment thereto that does not affect its substance, by a decree issued in the Council of Ministers upon the proposal of the Minister of Justice.
Article 1027
Pursuant to the provisions of this Law, courts that have become incompetent to hear the pending cases before them shall administratively refer these cases to the competent courts.
Article 1028
The courts that uphold recognized principles have an interpretative character, and this character is particularly evident in the provisions of Articles 5, paragraph (3), 7, 368, 373, 527 with its two paragraphs, and 557.
Article 1029
The new provisions contained in the chapter on arbitration do not apply to agreements, disputes or arbitration proposals prior to the date of enforcement of this law.
Article 1030
The following laws are hereby repealed: The Law of Civil Procedure issued by Legislative Decree No. 72 dated February 1, 1933 with its amendments. The Ottoman Procedure Law. The Procedure Regulations in force before this law.
Article 1031
The numbers of the articles of the Code of Civil Procedure mentioned in the texts of other laws shall be deemed to be replaced by the numbers of the corresponding articles of this Law. Furthermore, other legal texts that refer to the texts of laws whose rules have been incorporated into the articles of this Law shall be deemed to refer to these latter articles.
Article 1032
All texts of international treaties and agreements containing special rules concerning the principles of trial, the jurisdiction of courts or judicial authorities, the principles of execution, or rules of evidence are considered annexed to this law.
Article 1033
- Amended in consideration of the provisions of Articles 761, 931, 968, 1025, and 1026, paragraph 2, this Law shall come into effect as of July 1, 1985, with consideration given to its application period between January 1, 1985, and the date of its enforcement by this legislative decree.
