Section Second: Obligations of the Agent

Article 785

Art. 785 - The agent is required to perform the mandate with the diligence of a good father of a family.

Article 786

Art. 786 - The obligation mentioned in the preceding article shall be understood more rigorously: 1 - when the mandate is remunerated; 2 - when it is exercised in the interest of a minor, an incapacitated person, or a legal entity.

Article 787

Article 787 - The mandatary is obliged to inform the mandant of all circumstances which could determine the latter to revoke or modify the mandate.

Article 788

Art. 788 - As soon as the mandate is accomplished, the agent is required to immediately inform the principal, in such a manner as to enable the latter to obtain an exact account of how their mandate was executed. If the principal, after receiving notice, delays in responding, without a plausible reason, longer than is warranted by the nature of the matter or custom, they are deemed to approve, even if the agent has exceeded their powers.

Article 789

Article 789 - The mandatary is obliged, at the request of the mandant, to render him account at all times of his management and to restore to him everything he has received on this ground, to whatever title that may be. He owes him interest on the sums for the payment of which he is in delay.

Article 790

Art. 790 - The agent is liable, under the conditions provided for in articles 696, 697, 711, 712, 714, and 715, for the things he has received as a result of the agency. If the agency is remunerated, his liability is governed by article 713.

Article 791

Article 891 - When there are several mandataries, there is solidarity between them only if it has been stipulated. However, solidarity between mandataries is by law: 1 - when the damage caused to the mandant is the result of a common fault and concerted between them; 2 - when the mandate is indivisible; 3 - when the mandate is given between merchants for commercial affairs, if there is no contrary stipulation; In no case do mandataries, even if solidary, answer for what their co-mandatary has done outside or by abuse of his mandate.
