Article 988

Article 988 - The insurer against fire is liable for all damages caused by conflagration, blaze or simple combustion. However, he is not liable for those caused by the sole action of heat or by the direct and immediate contact of fire or an incandescent substance, if there has been neither fire nor beginning of fire liable to degenerate into true fire.

Article 989

Art. 989 - Material damages resulting immediately and directly from the fire or the start of a fire are the sole responsibility of the insurer.

Article 990

Art. 990 - Material damages occasioned to objects covered by the insurance by rescue operations and salvage measures are deemed equivalent to direct material damages.

Article 991

Art. 991 - The insurer is liable, notwithstanding any contrary stipulation, for the loss or disappearance of the insured objects that occurred during the fire, unless it proves that such loss or disappearance resulted from theft.

Article 992

Article 992 - The insurer, in accordance with article 968, is not liable for losses and deterioration of the insured object resulting from inherent defect, but he guarantees fire damages which are the consequence of it, unless he is entitled to request the nullity of the insurance contract by application of article 982, first paragraph.

Article 993

Art. 993 - Insurance does not cover fires caused by volcanic eruptions, earthquakes, hurricanes, whirlwinds, and other cataclysms. However, it covers those caused by lightning.

Article 1020

Art. 1020 - Accident insurance is a contract whereby the insurer undertakes, in consideration of a premium, to pay a determined capital or annuity either to the insured themselves, or to their heirs or assigns, or to designated beneficiaries in the event of death or permanent or temporary incapacity to work resulting from any accident or a specific type of accident affecting the insured. The insured may be either the policyholder themselves or one or more persons in whose interest the policyholder has entered into the insurance contract. The provisions of this title relating to life insurance shall apply to accident insurance, except for the exceptions and modifications indicated in the following articles.

Article 1021

Art. 1021 - In accident insurance, the payment of the premium is mandatory.

Article 1022

Art. 1022 - The provisions of this title relating to reduction and redemption in the matter of life insurance do not apply to insurance against accidents.

Article 1023

Art. 1023 - When the insured is not the policyholder, they may, by way of exception to article 998, be designated by mere indication of their profession or function. In this case, the provisions of article 996 which prohibit contracting an insurance policy on the head of a minor under the age of fifteen are inapplicable.
